Purchase Contract of Celestial Thyme Terms & Conditions 

1.1 This website is operated by Odysseia PTY LTD and trading under Celestial Thyme. All purchases made on this website are governed by these Celestial Thyme Terms and Conditions.

1.2 We sell goods only to end-user consumers. All goods are sold subject to the Terms and Conditions that they will not be re-sold or otherwise circulated without our prior written consent. Afterall does not apply to wholesale customers.

1.3 At first we will confirm acceptance of your order, when placed. This will either be by a message on the website immediately after you have confirmed your order, or by us sending an e-mail to the email address you have provided to us. We may do both. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Celestial Thyme Terms and Conditions.

Price and Delivery Charges

2.1 The price of Celestial Thyme goods will be as quoted on the website at the time you confirm your order. If you subsequently amend your order, the prices charged will be those applicable to the amended item(s) at the time that the amended order is confirmed.

2.2 Prices may be subject to change based on the cost of raw materials and ingredients, but always communicated in advance.

2.3 The prices stated on the website will be all inclusive of any GST payable.

2.4 The price of the goods does not include a charge for delivery, unless the total value is over AUD$60 within Australia or over AUD$100 Internationally.

Methods of Payment

3.1 Payment may be made by debit or credit card. You cannot pay for an online order by cash or cheque. There is no minimum order requirement, except for international orders. Minimum order for outside of Australia is AUD$100.

3.2 The debit and credit cards accepted by us are those listed on the website on the date on which your order is placed.

3.3 Authority for payment will be requested from your card issuer at the time of your order. We reserve the right to terminate our agreement with you if we are refused authority for payment at any stage.

3.4 You agree to indemnify us in full against all costs, expenses and outgoings incurred by us in obtaining payments from you in the event a failed payment occurs. We may, at any time after a failed payment has occurred, ask a debt collection agency to collect payment from you.

Delivery

4.1 Delivery will be made to the address specified by you when you complete your order on the website. We will refund your order if we can not deliver to your area.

4.2 Products are subject to availability. The website is updated on a weekly basis but in the event of non-availability of any goods you order, we may offer a reasonable substitute and make sure to communicate with you.

4.3 We will always try to supply you with the full quantity that you have ordered. In the event that the goods delivered to you are incomplete or include incorrect goods, you must notify us promptly. Our resources will allow us to fully track back the history of it. If you are not satisfied with the quantity you have received we will arrange with you for these goods to be returned to us (please note that the goods must not be used and must be in good condition). You will not be charged for any incorrect goods or goods which you have not received. In any event, our liability will be limited to the price of the goods not delivered or incorrectly delivered and the cost of delivery.

4.4 We will deliver the products ordered by you to the address you give us for delivery at the time you make your order. It is, however, your responsibility to provide us with accurate delivery address details. We will not check or verify addresses and messages supplied by you. We shall have no liability to you whatsoever, financial, administrative or otherwise, if you do not receive your order as a result of you providing incorrect delivery address details. It is your responsibility to ensure that an appropriate person is available at the delivery address at all times during the delivery slot. An appropriate person must sign for all goods on delivery or fill in the form to authorise to leave parcels unattended and purchaser takes full responsibility for goods left unattended. In all cases, notification of delivery will be given. It is your responsibility to re-arrange and pay for delivery, where appropriate. Please note adverse weather conditions or other events outside of our control may result in the occasional late or cancelled delivery. If that is the case we will endeavour to contact you as soon as we are able in order to reschedule your delivery time and date. In any event our liability to you will be limited to the price of goods not delivered and the cost of delivery.

Ingredients in our Products

All our goods are made with tender loving care charged with positive intentions. All our resins and botanicals are 90% food grade and 100% wildcrafted, and our incenses are nit intended to be ingested. Please keep our products away from children. In the event that a child does ingest any of our products, please make sure that the child has access to pure water. Please refer to 6.2.

Defective Goods

6.1 We guarantee the quality of our products. You must inspect the products and notify us promptly of any dissatisfaction with your order. We will promptly and fully refund the cost of any products if one of the criteria set out below applies to the product/s delivered to you:

The products are not what you ordered; The delivery is of an incorrect quantity; or If you do not receive the products ordered.

We will arrange with you for the products to be returned to us. We reserve the right to make any refund due to you in whatever way we choose.

Contraindication – Safe use

6.2 All our ingredients is safe and 90% food grade. Should a child handle or ingest the incense may cause some side effects, such as skin rash if applied directly to the skin. Please use our incenses and botanical products as they intended to be.Our incenses are to be handled by adults only. Just like any botanicals, it is highly recommended that they be used and applied directly as they intended. Even the most beneficial natural ingredients can prove different under certain conditions. Our ritual incense blends are highly concentrated and very strong, and just because they come from a natural botanical or are derived naturally from nature, doesn’t mean that can not cause reactions. Inappropriate use can often lead to damaging side effects. As always please consult your physician or medical professional in case you ingested the blends by accident. Our blog will dive deeper into the marvelous ingredients we are fortunate to share with all.

Amendment of Orders and Cancellation Rights

7.1 Celestial Thyme cannot accept cancellation, exchange or refund goods due to the rare exclusive nature of the product. Orders may be cancelled if the product has not been dispatched.

Warranty and Liability

8.1 Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence; neither will any of these terms restrict any of your statutory rights.

8.2 In addition to paragraph 4.4 we will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.

8.3 Other than as set out in clause 7.1 above, our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods and delivery contained in that order.

At Celestial Thyme, we are committed to providing an excellent service. If however, we have sent you products that you are not pleased with, contact us with your comments. We are always looking for ways to improve our service and products. Any comments and customer complaints should be addressed to us via the e-mail address which is listed on our website on the Contact Us page.

Notices

Unless otherwise expressly stated in these Terms and Conditions, all notices from you to us must be in writing and sent to us via the email address listed on the Contact Us page on our website. All notices from us to you will be displayed on our website from time to time.

Privacy Policy

You acknowledge and agree to be bound by the Celestial Thyme terms of our privacy policy.

General

12.1 If any of these Celestial Thyme Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

12.2 All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us.

12.3 The information contained on this website, and those websites to which there are links, is for general interest only. While care has been taken in its preparation, no responsibility is accepted for any misleading information or errors within this or other websites quoted.

12.4 All photographs published on this website are the copyright of their respective owners, whose permission should be sought in writing for their use by other parties.

12.5 The design of this website is copyright of Celestial Thyme. No unauthorised use of its contents is permitted without prior permission of the copyright holders.

12.6 These Terms and Conditions will be governed by Australian law and the parties submit to the exclusive jurisdiction of the Australian courts in relation to any dispute which may arise between them.

12.6.1    Dispute Resolution

12.6.2            Compulsory:

If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent  interlocutory  relief  is sought).

12.6.3            Notice:

A party to the Terms claiming a dispute (‘Dispute ‘) has arisen under the Celestial Thyme Terms and Conditions, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.

12.6.4            Resolution:

On receipt of that notice (‘Notice ‘) by that other party, the parties to the Terms (‘Par ties ‘) must:

(a)      Within 14 days of the Notice endeavour  in  good  faith  to  resolve  the Dispute expeditiously by negotiation or such other means upon which they may  mutually agree;

(b)      If for any reason whatsoever, 14 days after the date of the Notice, the Dispute has not been resolved, Cleetsial Thyme will assign a mediator or request that an appropriate mediator  be appointed by the President of the Australian Mediation Association or the Conflict Resolution Service or his or her nominee;

(c)      The Parties are equally liable for the fees and reasonable expenses of a mediator  and the cost of the venue of the mediation and without limiting    the foregoing undertake to pay any amounts requested by the mediator as    a pre-condition to the mediation  commencing. The Parties must each  pay their  own costs associated with the  mediation;

(d)      The mediation will be held in NSW, Australia.

12.6.5.            Confidential

All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as “without prejudice” negotiations for the purpose of applicable laws of evidence.

12.6.6            Termination  of Mediation:

If 2 weeks have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.

12.6.7    Venue and Jurisdiction

The Purchase Services offered by Celestial Thyme is intended to be viewed by residents of Australia. In  the  event of any dispute  arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of NSW, Australia.

12.6.8.    Governing Law

The Terms are governed by the laws of NSW, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed,  interpreted and construed by, under and pursuant to the laws of NSW, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause  is not contested. The Celestial Thyme Terms and Conditions shall be binding to the benefit of the parties hereto and their successors and assigns.

12.6.9    Independent Legal Advice

Both parties confirm and declare that the provisions of the Terms are fair and reasonable and both parties having taken the opportunity to obtain independent legal advice and declare the Celestial Thyme Terms are not against public policy on the grounds of inequality or bargaining power or general grounds of restraint of trade.

12.6.10  Severance

If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.

12.7 These Terms and Conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the products to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these Terms and Conditions or as an authorised representation about the nature or quality of any products offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading

12.8 Subscription, we require a 12 months minimum sign up for the subscription. You will be charged for the remainder of the 3 months if you cancel within the period. Please consider this before signing up.

SHIPPING

Shipping policy

Celestial Thyme Incenses are shipped by TNT couriers with priority shipping, we use eco alliance approved sustainable packaging to ensure your goods arrive in optimal conditions.

We will deliver the products ordered by you to the address given by you at the time you make your order. It is, however, your responsibility to provide us with accurate delivery address details. We can give a tracking number once items shipped if requested but we will not check or verify addresses.

We shall have no liability to you whatsoever, financial, administrative or otherwise, if you do not receive your order as a result of you providing incorrect delivery details.

Please ensure that someone is at the delivery address to receive the package, we do not take responsibility for packages left unattended.

We do give authority to leave on all packages to save the item from being returned to a post office. We want you to receive your incenses as fast as possible.

Please Note : Adverse weather conditions, busy holiday periods or other events outside of our control may result in the occasional late or cancelled delivery.

Celestial Thyme is handmade and gathered freshly adjusting to the seasons and while most orders are processed and ready for shipping within 2-5 business day; some orders may take additional time. We do not post on Fridays, Saturdays, Sundays or Public/ Bank holidays to avoid orders being stuck in transit. We trust that our carefully selected mail will deliver your order on time. Celestial Thyme cannot be held responsible for any damage or for conditions beyond our control such as severe weather service interruptions etc.

 

FINAL REMINDERS

Never leave burning charcoal, resin or candle unattended. Keep incense vessel on fire proof surface during the incense burning ritual. Use sand to extinguish the charcoal or burning resin.

Do not throw incense into fireplace/wood burning stove, as the precious, fragrant smoke will escape unnoticed together with the wood smoke. Do not use BBQ charcoal for incense burning. Do not use incense in enclosed space like Sauna etc.

To release the aroma contained within the resin pieces into the air, tree resins have to be exposed to stable heat.

Place Celestial Thyme Incense Rituals on a lit charcoal tablet that has been placed on sand  or recycled charcoal sand in a fireproof vessel, or in an electric incense burner.
